Why Should You Request a DMV Hearing?

New Colorado Law: Longer Suspensions and Required Ignition Interlock

The law has changed. For arrests after January 1, 2009, all drivers who have lost their drivers license through the Department of Motor Vehicles for a .08 violation (DUI) must have an ignition interlock installed on their car before their driving privileges are reinstated. You bear the installation costs and monthly fees. You will have to blow into this "breathalyzer" every time you drive. If the interlock detects alcohol, (a) the vehicle won't start and (b) the device alerts the DMV, resulting in a violation and fines.

License Suspension Penalties

For a first offense DUI (.08 BAC), the license suspension is now nine months. But after a 30-day suspension, you can apply for reinstatement, with ignition interlock for the remaining eight months. For a .17 BAC or more the suspension is nine months. You can apply for reinstatement after a 30 day suspension, but the ignition interlock will be two years.

On a second DUI, the license revocation is one year (no provisional "red license") and ignition interlock is required for two years after reinstatement. For a third offense or any subsequent offenses, there is a two-year revocation.

Drivers under 21 have very fact specific Department of Motor Vehicle consequences. In some limited circumstances, they can apply for a probationary license, but in most cases will face longer suspensions.

ALWAYS Request a DMV Hearing

  • You can continue driving with a valid license until the DMV hearing date, which may be as much as 60 days later. Your license is automatically revoked after seven days if you do not request a hearing.
  • We usually subpoena the arresting officer. If that officer does not show up, you will generally win — your license will not be suspended.
  • If the officer does appear, we ask questions about your traffic stop, roadside tests and arrest. We always learn something about your case that assists us with the court process.
