GEOFFREY HEIM: And actually there are three ways in any DUI case the Department of Motor Vehicles can take your driver's license. The first is the hearing that determines whether your blood or breath was above a .08. The second is if you are convicted of driving under the influence or driving with excessive alcohol concentration. Just the charge alone, the state has said, merits a one-year suspension of your driving privilege.

The third way is if you accumulate out of any of the charges of the DUI case and the cases that you may have had before that, be it a speeding ticket or a stop sign violation, if you hit 12 points in a 12-months period, the state will take your driver's license for one year.

That DUI case is going to take at least six months to resolve itself. So when our clients come in, the first thing we want to do is put them in the position to succeed throughout that case. We get them into an alcohol class early because they're going to have to do it either for the Department of Motor Vehicles or the court, most likely for both. We have them start doing their community service ahead of time as that's a prerequisite. We also have them start looking ahead to making alternate driving arrangements in the event that they lose a driver's license.

Most of what our firm does in any criminal case, not just DUI cases, is making our clients get into the position that they can best achieve success through the court case, whether that's getting the case dismissed or mitigating or minimizing the circumstances that they'll find themselves in.
