At that time, he's going to request documentation for you. And you've got to remember that when you're pulled over for a DUI, the officers are looking to see if you're intoxicated. They're making observations each step of the way. They'll notice things like if you fumble for your driver's license. They'll notice if you're fumbling for your registration. If you can't find your insurance paperwork, of you've handed them an improper insurance card because you have two in your car. That will end up in their police reports. So when you first are contacted by the police, you want to present yourself as rational and coherent. The next thing the police officer will do is after he checks your background information and as well as your documentation, he or she is going to ask you to step out of the car. They want to at that point see your physical demeanor, whether you're stumbling, whether you are unsteady on your feet, whether you need to use the car as support. They're going to ask you to do voluntary field sobriety tests. And they are voluntary. You do not want to do those tests. All they're doing is they're scoring you negatively for the things you do poorly and they're not giving you credit for the things that you do well. GRAPHIC: Moran & Heim P.C.
